Miami Police Used Fingerprints to Falsely Arrest Foreclosure Maintenance Man for Burglary

Most burglars wouldn’t bother cutting the lawn. But on an April day in 2014, that’s exactly what raised the suspicions of a woman in one Miami neighborhood. When she saw a strange man cutting the grass outside a home on SW Fourth Street, she called the homeowner to let him know.

A crime scene technician from the Miami Police Department soon showed up to dust the home for fingerprints, which an examiner later used to identify a suspect. Almost one year after the break-in, 25-year-old Alden Chase was arrested on charges of burglary and grand theft.

But it turns out Chase had a good reason to be at the house that day: He was working for a maintenance company hired by the bank, which had filed to foreclose the home. What’s more astonishing, his lawyer says, is that Chase had posted a notice directly on the front window indicating he’d been there that day to mow the lawn, change the locks, and secure the residence.

Apprised of the mistake, the State Attorney’s Office dropped the case. Earlier this month, Chase filed suit against the City of Miami for false arrest.

“It’s unique because of the obviousness of the situation,” says his attorney, Michael Garcia Petit. “They were aware there was litigation between the homeowner and the bank. If you or I as laypeople, not trained law enforcement, came up and observed this, we’d realize we’d probably want to call the maintenance company and the bank to ascertain whether they’d been on the property.”

The City of Miami attorney’s office did not respond to an email from New Times seeking comment on the case; in most instances, the office declines to comment on pending litigation.

Although the charges were dropped about five weeks after Chase’s arrest, court records indicate he spent four days in jail before he was able to bond out. His mug shot remains on the internet. As a result of the arrest, Garcia Petit says Chase lost his job and has been hard-pressed to find work.

“The problem he now encounters with each and every job is it shows that he has been arrested for burglary and grand theft, which is not a real good thing to have on your record,” the attorney says.

Though he’s waiting for more documentation, Garcia Petit says he still isn’t sure how Miami Police could have arrested Chase nearly a year after the burglary without so much as interviewing him or calling the maintenance company’s phone number from the notice posted outside the home.

“Throw common sense out, because common sense doesn’t work here,” he says. “What happens is they’re on autopilot and they don’t investigate. They arrested him, and I’ve still got no idea why.”

It is also important to understand that there are generally four primary types of Oregon detox centers or detox clinics in Oregon. Depending on the severity of the substance abuse and the types of drugs or alcohol being abused may also dictate exactly which kind you need.

1)Inpatient Hospitalization in Oregon An inpatient hospitilzation is a brief stay at an actual hospital. This is usually only recommended (or even permitted) when there is a grave medical danger present, either due to the amounts being abused or the extreme risks associated with the withdrawal. Generally speaking, an alcohol, tranquilizer or benzodiazipine withdrawal where seizures, major heart conditions, or blood pressure risks are high would involve an inpatient Hospitalization. An opiate user (Vicadin, Heroin, Hydrocodone, Moprhine, Oxycontin, etc) will almost never be admitted into a hospital inpatient for there is almost no medical danger (outside of increased blood pressure) present, however uncomfortable the detox may feel. A cocaine or methamphetamine user will also usually not be admitted, however, they may be temporarily referred to a psychiatric facility if there are major psychoses present as a result of the abuse and prescribed anti-psychotic medications.

2)Medically supervised detox center in Oregon. Any medically supervised detox centers in Oregon are generally ones that have some form of medical supervision, although not to the degree that an inpatient hospital may. In addition, there are often medications that are either recommended or required to make the detox medically safe and comfortable. Alcohol, benzodiazipenes are almost usually recommended to be medically supervised, whether within a medically supervised detox or a more monitored inpatient hospital stay. An opiate user isn t technically required to be medically supervised, however, an opiate user will very rarely stay through the entire withdrawal process without the aid of other drugs to alleviate the uncomfortable symptoms.

3)Non medically supervised detox facility in Oregon. A non medically supervised detox facility may have trained or certified staff members, but there are not any medications provided to alleviate symptoms. Most non-medical detoxes will not admit a benzodiazipene, tranquilizer, or heavy alcohol abuser for this reason. They will admit an opiate user, but with the understanding that they will have to tough out the uncomfortable withdrawal. Cocaine and methamphetamine users can almosr always safely withdraw in a non-medical detox center in Oregon.

4) Methadone Clinic in Oregon: A methadone clinic is not actually a detox , although methadone is sometimes used to help someone to stop using opiates. Uinderstand that methadone is a highly addictive substitute where the withdraw can be up to three times worse than heroin. Sober Solutions does not endorse nor advocate the use of methadone clinics. Due to the difficulty of the withdrawal, a detox clinic in Oregon is also very rarely a methodone detox itself.

Farm Bureau has paid every claim we have had fairly and quickly. I hydroplaned after a tire blew out and my Honda flew over an deep embankment and landed upright but the damage was significant. Again, I was easing out of a parking place at a restaurant when a large pickup blew through the lot and couldn’t stop. My car was a total loss and Farm Bureau gave me what seemed to be more than they needed to based on my research of my car’s worth. A third time, I bumped someone at a right turn stop sign and they took care of the dent on the other car, no questions asked. If I were them, I would refer me to another company, but they continue to offer great service at an very fair price and have just insured our new condo at an excellent rate..

Paid every claim we had with no problems. We were involved in agriculture and had several accidents. One involved one of our trucks hitting a gasoline carrier. Brakes on our truck went out on a crossroad and tore open the gas truck. Closed main highway for about 3 hours. Farm Bureau took care or it all.

We were rear ended by a driver with Farm Bureau insurance. My wife and I both had injuries, and Farm Bureau were compassionate and efficient in quickly making sure that we had sufficient money to pay our medical expenses.

Have had them for 16 years, they have the best rates. great customer service and they truly care

Working with insurance adjusters on a daily basis, I couldn’t image carrying insurance through any other company. I find Erie to be the most likely to settle claims, which makes me feel extremely well-covered when I’m on the road. I know that if something happens, and the other person doesn’t have insurance, my company will take care of me without pushing back or thinking of dropping me. I love ERIE!.

I have had ERIE for auto and home owners for 35+ years. Having done comparisons from time to time, I have not been able to get better rates and coverage for my dollar spent. Their claims service, to me, is outstanding. They are truly Above All in Service The only draw back is that they are somewhat regional.

Left Nationwide after 33 years for Erie. 3 Cars and 2 House policies and saved over 30%. Now that’s a big savings that no one could match for the same coverage. Nothing wrong with Nationwide, just kept increasing the price with no claims. After a lot of checking, Erie was the best choice to be found.

Been with erie for years and let me tell you they are definitely the cheapest insurance around.

25Infinity Insurance

Sucks to be the guy you hit but it’s cheap.

ALTHO they did not give me discounts, at least they did not charge an arm and a LEG after my one accident. Mercury has been faithful and very helpful when I am a couple days late on payment. DARN ALLSTATE! They paid the other party over and over and over, even though the damage to my fender was worse, they only had a slight tap on rear end, but got FULL VALUE for their ‘destroyed’ car, and all 5 occupants got PT and chiropractic visits 3x each. I WAS ANGRY! They were not injured, and the car was repairable. But Mercury came through and gave me a good deal for the upcoming years!

Mercury gave me a lower auto insurance quote than any of the others that I have checked that are ranked higher on this list.

We used to have Geico. We have a clean driving record no accidents and our insurance goes up. So we changed to Elephant and love it! And it is a whole lot less with the same coverages.

28Auto-Owners Insurance

I’ve dealt with them on two homeowner claims (for my grandmother) and three auto claims (a $68k uninsured motorist claim and a broken windshield claim on my cars and my mom’s car after she hit a deer). These claims have spanned the last nine years and each one was handled with a high level of professionalism, but also with decency, kindness and compassion. They are truly an honest company that pays the claims they owe quickly and fairly. When I was injured by the uninsured motorist in 2010, the first thing my attorney said when he saw that I had A-O was you have nothing to worry about, they will take care of you.

Actually pay claims. Even when on an older vehicle with little damage.

The rates are much better on a Homeowners policy than I have ever had with State Farm or Grange. Great agents also.

Very prompt in handling and paying the only claim I have had with them which was roof replacement on my ho me. H ave never had to make a claim on my auto insurance with them but presume they would handle it in the same satisfactory way. I like their discount for paying annual premiums in full. I also like the fact that they do not spend exorbitant amounts of money for misleading T.V. commercials as many other companies do.

They have the lowest complaint ratio in California. They mainly market to teachers, police officers, fire fighters, and nurses. They’re also endorsed by the NEA and California Teacher’s Association. They’re a great family owned company!

California Casualty is a great company! Association based, they work with teachers, fire fighters, policemen and nurses. They have to adhere to a higher standard when responding to claims so they don’t lose their endorsements. They are endorsed by over 1k associations nationwide. They also have the NEA endorsement. 97% claims satisfaction.

34Lincoln Insurance

I have been with State Farm for 35 yrs. And it’s time for a change. I rec’d my new premium and it increased $341. Encompass was less than half.
Since they are a subsidiary of Allstate and their reviews are good, I will be going with them. State Farm has been good for me, but now in 2013, I can’t afford to be paying out all these increases for exactly the same coverage. Bye, bye SF xoxoxo

Awesome insurance and great coverage. You will know their goodness if you ever need your car repaired. Even in a not my fault accident, PEMCO provided all the assistant needed in dealing with other person’s insurance.

      Jennifer Evans, Psy.D. earned her doctoral degree in clinical psychology from the California School of Professional Psychology (at Alliant International University) in San Francisco, CA. She completed an APA-approved predoctoral internship and a Multicultural Postdoctoral Residency at San Jose State University s Counseling Services. She was first licensed as a psychologist in California in 2011, and has been licensed as a Florida Licensed Psychologist since 2014.

      Dr. Evans has experience providing individual and group therapy to adolescents and adults in community mental health, substance abuse facilities, and college counseling centers. Dr. Evans brings experience with a broad range of psychiatric and psychological issues to our practice as well as interests in helping individuals examine and work with issues relating to the intersection of identity and social, cultural, and systemic impacts.

      Much of Dr. Evan s psychotherapeutic emphasis has focused on individuals diagnosed with anxiety disorders. social anxiety disorder. depression. alcohol and substance abuse, ADHD and learning difficulties. Her therapeutic focus also includes stress management and adjustment issues, trauma, women s issues, social skills difficulties, gender identity and sexuality issues, and cultural identity concerns.

      Dr. Evans incorporates Cognitive Behavioral Therapy (CBT) and other psychological treatment approaches in her work with patients. Her perspective benefits from her interest in multicultural feminist psychology, as well as strong interest and experience in exploring and assisting individuals with self-concept, self-esteem, identity, and the process of personal growth and change. Her focus involves examining and working on thoughts and behaviors which may negatively impact resiliency, self-concept, adjustment or mood and working through a process of exploration and change.

      Dr. Evans has experience and training in serving a diverse set of populations suffering from milder to more severe ranges of life difficulties and psychopathology. She has provided individual therapy, family therapy, and/or case management to college-age students, adolescents and family members involved in residential treatment for addictions, individuals with severe or debilitating mental illness, and with HIV-positive patients in a community mental health setting. Dr. Evans has experience in providing group therapy to adults, children and adolescent. She has provided group therapy to college students, and group therapy to children and adolescents with social skills deficits.

      Dr. Evans has a high level of specialty expertise in providing mental health services to LGBTQ clients and communities (particularly transgender clients) to the CPANCF staff. Dr. Evans has provided training to medical and mental health care providers in the provision of culturally sensitive services to transgender clients, including utilization of the WPATH Standards of Care. Dr. Evans was integral in the program development, implementation, and evaluation of the Safe Zone training program at the University of Central Florida.
