California ranks highest for workers’ compensation costs

California has been ranked as the most expensive state for workers’ compensation costs, according to a newly released report.

The Workers’ Compensation Premium Rate Ranking Summary from Oregon’s Department of Consumer and Business Services shows that California businesses spend $3.48 for every $100 of payroll issued.

That’s 188 percent of the median cost of $1.85 for all 50 states. California was the third most expensive state in 2012 and the fifth most expensive in 2010.

“California’s workers’ compensation system is incredibly inefficient,” said Jerry Azevedo, a spokesman for the California-based Workers’ Compensation Action Network, which seeks to reduce costs for employers and improve services to injured workers. “It does not do a good job of achieving its goal. For as much as employers pay, they don’t get a lot out of it.”

That also applies to injured workers, according to Azevedo.

“You would think that since California has the highest cost system that we’d also have the most generous benefits — but we don’t,” he said. “We plow a lot of money into the system but too little of it ends up in the hands of injured workers.”

Much of the money goes to lawyers who dispute medical treatments, while other money goes to commissions paid to brokers and various administrative costs, Azevedo said.

Connecticut ranked second on the list with $2.87 of every $100 in payroll going toward workers’ compensation costs. That was followed by New Jersey ($2.82), New York ($2.75), Alaska ($2.68) and Oklahoma ($2.55).

North Dakota ranked lowest, with just 88 cents of every $100 in payroll going toward workers’ comp costs.

Because states have various mixes of industries, the study calculates rates for each state using a standard mix of the 50 industries with the highest workers’ comp claim costs in Oregon.

California employers are required by law to have workers’ comp insurance, even if they have only one employee. The California Department of Industrial Relations (DIR) imposes assessments on employers to cover the cost of potential workers comp claims. The amount a business pays into the system depends on how many employees a business has and what its total payroll is.

DIR Director Christine Baker said Oregon’s Workers’ Compensation Premium Rate Ranking Summary is skewed and that the mix of industries and other factors are “apples and oranges” to the reality of workers’ compensation in California.

That may be true, but California businesses are definitely grappling with high workers’ comp costs — and a lot of aggravation.

Mike Hilgert, president of Superior Duct Fabrication in Pomona, said his company deals with a variety of workers’ comp claims. Some are legitimate, he said, but others are questionable.

“Something needs to be done about this,” he said. “It’s costing us a lot in attorney fees.”

Hilgert said insurance companies need to investigate more of the claims to ensure they are legitimate.

The Workers’ Compensation Action Network said costs associated with workers’ comp claims “drain dollars that should be going to job creation, employee benefits, company growth and public services in California.”

California’s lowest ranking since 2000 occurred in 2008 when the Golden State ranked 13th in workers’ comp costs, and that came only after legislative reforms helped reduce employer premiums by 66 percent from 2003 levels. But those reforms were later eroded by court rulings and new abuses by system vendors, Azevedo said.

“Since 2009, premium costs in California have climbed by 41 percent due, in part, to an increasing rate of work-injury claims at a time when the rate of claims in most states has been declining,” he said. “California’s system is experiencing more claims for cumulative trauma and those filed post-employment — particularly in the Los Angeles region. Average costs per claim have increased by $30,000 since 2005.”

Reforms enacted in 2012 under Senate Bill 863 ushered in new tools to reduce litigation and improve efficiency. The projected savings from these measures were put toward increasing benefits for injured workers by more than $1 billion, Azavedo said.

“Whether these cost offsets will be sufficient to fully pay for the benefit increase remains to be seen,” he said. “Meanwhile, employer costs have increased since 2012 and the reforms are highly vulnerable to new abuses and legal rulings that run counter to the legislature’s intent.”

Baker said the workers’ comp reforms of SB 863 have not yet been fully implemented. But costs are going down, she said, and the benefit delivery to injured workers has improved.

      Veterans On-Line Application (VONAPP)

      Four forms are now available on the vets.gov site. They are the 22-1990, 22-5490, 22-1995, and 22-1990E. If you select any of those forms within VONAPP, you will be redirected to the vets.gov site.

      The final 2 education forms, the 22-5495 and the 22-1990N will be removed from VONAPP in May. All educations forms will be accessed through vets.gov.

      As of September 20, 2015, you can now apply for Vocational Rehabilitation and Employment (VR E) benefits online through eBenefits. If you were routed here to the Veterans Online Application (VONAPP) page by mistake, please go back to the eBenefits homepage and login.

      Once logged in, on the left hand side of the page:

      – From Dashboard column, go to �Additional Benefits� under Benefits and Payments

      – From the Additional Benefits page expand the VR E link

      – Select apply for either Vocational Rehabilitation and Employment Program or Education/Career Counseling

      There are various forms of asbestos disease. The most common forms of asbestos disease can be broadly set out as follows:

      • Mesothelioma – a cancer of the pleura, being the lining of the lungs and other internal organs which can be caused by relatively low exposure to asbestos fibres
      • Lung Cancer – a cancer of the lung tissue which can be caused by significant exposures to asbestos, even where other factors are also present such as a history of smoking
      • Asbestosis – scarring in the lung tissue which is usually caused by significant exposures to asbestos, dust and fibre. Although not a form of cancer, this condition can nevertheless be progressive;
      • Pleural Plaques – calcium deposits on the lining of the lungs which usually occurs in areas affected by asbestos exposure. Pleural plaques can cause breathing restriction and chest pain
      • Asbestos Related Pleural Disease – other conditions affecting the pleura caused by asbestos exposure which can also cause breathing difficulties and chest pain
