Ever wonder where the exact line of your property begins or ends? Need to settle a border dispute with your neighbor? It is surprising how many people do not know where the precise edges of their boundaries are. Often, they have been lost in the many times their property has changed hands over the years, or assumed to be consistent with existing fences or landscape boundaries. The confusion over property boundaries is the basis of many neighbor disputes, including encroachments (or perceived encroachments) on one’s property. This section contains information to help you determine exact property lines, where property lines should be, and what you can do if your neighbor starts using your property without permission, either knowingly or unknowingly.

Fences and Fence Ordinances

The height, location, appearance, and materials used for fencing are often regulated by local fence ordinances; while some homeowners’ associations may place additional restrictions on fences. Most jurisdictions allow homeowners to get approval for certain exceptions, such as a higher fence. But many fence ordinances do not regulate the aesthetics of the fence, which means a fence cannot be ordered removed simply for being ugly.

Most fences are built right on top of property boundary lines, which means the fence is the property of the homeowners on both sides of the fence. Therefore, its upkeep and eventually replacement is the responsibility of both homeowners. If tree limbs hang over the fence and into your property, you may legally cut those limbs but only if it doesn’t damage the health of the tree.

What are My Property Boundaries?

Ideally, the land survey or subdivision plot on file at your city or county clerk’s office will provide detailed information about the precise boundaries of your property. But these are not easily understood by the lay person and may require the help of a professional surveyor. A surveyor will access the corresponding documents and then use special instruments to mark the boundaries of your property. If there are several documents on file indicating different property lines, then the job may be more complicated and ultimately cost more.

Changing the Boundaries by Agreement

Property lines are not carved in stone and may be changed through mutual agreement. If, for example, the fence is too far in from your actual boundary — meaning a small piece of your property is actually on your neighbor’s side of the fence — it could cause problems when you try to sell your house. Getting the property line officially changed through a lot line agreement can remedy this, as long as it complies with local zoning and neighborhood laws.

But keep in mind that your bank (or your neighbor’s bank) may not approve of a boundary change if one or both of the homes is still under a mortgage.

When the boundary is changed, it gets recorded in the county office and made available to the public.

An encroachment occurs when your neighbor intrudes on or over land with some kind of a structure, such as a fence or a deck that veers across the boundary line. Even if you personally don’t mind about the encroachment, it’s important to at least acknowledge its existence for when you sell the home. Sellers are obligated to disclose any known encroachments on the property, which could impact your ability to sell the home. An alternative is to change the boundary through a lot line agreement, which gets recorded in the official records.

California ranks highest for workers’ compensation costs

California has been ranked as the most expensive state for workers’ compensation costs, according to a newly released report.

The Workers’ Compensation Premium Rate Ranking Summary from Oregon’s Department of Consumer and Business Services shows that California businesses spend $3.48 for every $100 of payroll issued.

That’s 188 percent of the median cost of $1.85 for all 50 states. California was the third most expensive state in 2012 and the fifth most expensive in 2010.

“California’s workers’ compensation system is incredibly inefficient,” said Jerry Azevedo, a spokesman for the California-based Workers’ Compensation Action Network, which seeks to reduce costs for employers and improve services to injured workers. “It does not do a good job of achieving its goal. For as much as employers pay, they don’t get a lot out of it.”

That also applies to injured workers, according to Azevedo.

“You would think that since California has the highest cost system that we’d also have the most generous benefits — but we don’t,” he said. “We plow a lot of money into the system but too little of it ends up in the hands of injured workers.”

Much of the money goes to lawyers who dispute medical treatments, while other money goes to commissions paid to brokers and various administrative costs, Azevedo said.

Connecticut ranked second on the list with $2.87 of every $100 in payroll going toward workers’ compensation costs. That was followed by New Jersey ($2.82), New York ($2.75), Alaska ($2.68) and Oklahoma ($2.55).

North Dakota ranked lowest, with just 88 cents of every $100 in payroll going toward workers’ comp costs.

Because states have various mixes of industries, the study calculates rates for each state using a standard mix of the 50 industries with the highest workers’ comp claim costs in Oregon.

California employers are required by law to have workers’ comp insurance, even if they have only one employee. The California Department of Industrial Relations (DIR) imposes assessments on employers to cover the cost of potential workers comp claims. The amount a business pays into the system depends on how many employees a business has and what its total payroll is.

DIR Director Christine Baker said Oregon’s Workers’ Compensation Premium Rate Ranking Summary is skewed and that the mix of industries and other factors are “apples and oranges” to the reality of workers’ compensation in California.

That may be true, but California businesses are definitely grappling with high workers’ comp costs — and a lot of aggravation.

Mike Hilgert, president of Superior Duct Fabrication in Pomona, said his company deals with a variety of workers’ comp claims. Some are legitimate, he said, but others are questionable.

“Something needs to be done about this,” he said. “It’s costing us a lot in attorney fees.”

Hilgert said insurance companies need to investigate more of the claims to ensure they are legitimate.

The Workers’ Compensation Action Network said costs associated with workers’ comp claims “drain dollars that should be going to job creation, employee benefits, company growth and public services in California.”

California’s lowest ranking since 2000 occurred in 2008 when the Golden State ranked 13th in workers’ comp costs, and that came only after legislative reforms helped reduce employer premiums by 66 percent from 2003 levels. But those reforms were later eroded by court rulings and new abuses by system vendors, Azevedo said.

“Since 2009, premium costs in California have climbed by 41 percent due, in part, to an increasing rate of work-injury claims at a time when the rate of claims in most states has been declining,” he said. “California’s system is experiencing more claims for cumulative trauma and those filed post-employment — particularly in the Los Angeles region. Average costs per claim have increased by $30,000 since 2005.”

Reforms enacted in 2012 under Senate Bill 863 ushered in new tools to reduce litigation and improve efficiency. The projected savings from these measures were put toward increasing benefits for injured workers by more than $1 billion, Azavedo said.

“Whether these cost offsets will be sufficient to fully pay for the benefit increase remains to be seen,” he said. “Meanwhile, employer costs have increased since 2012 and the reforms are highly vulnerable to new abuses and legal rulings that run counter to the legislature’s intent.”

Baker said the workers’ comp reforms of SB 863 have not yet been fully implemented. But costs are going down, she said, and the benefit delivery to injured workers has improved.

PSI Services, LLC, a California-based company providing state-based regulatory licensure services, handles the scheduling of examinations for individuals licensed by the California Department of Insurance’s (CDI) Producer Licensing Bureau.
